The tenancy is most likely governed by the statutory code set out in The Housing Act 1988.

Unless or until the law is changed, the tenancy type created by and governed by the provisions of this act (as amended by the Renters Rights Act 2025) are Assured tenancies.  This is the default tenancy type today and in most cases will be created automatically

Prior to the commencement of the Renters Rights Act 2025, the default tenancy type was the assured shorthold tenancy, but these were abolished by this act.

The Housing Act 1988 applies to all new tenancies unless they come within the tenancy or occupation types set out in Schedule 1 of the Act.  These include the tenancy types we have looked at earlier in this guide.
