Permission for Lodger Form

TATCC Document - Permission for a lodger Form

Use this form to amend your tenancy agreement if you agree to allow your tenant to rent a room at the property to a lodger under a 'lodger license'. You can read more about this topic in the articlehere.

  • Please give a title for this document (e.g. Lodger form re John Smith tenancy of 1A Acacia Avenue).

    This title will appear as the document name in your My Documents area, but not on the document itself.

    If you are viewing this after clicking the 'duplicate' button in My Documents, you should give your document a new name to prevent confusion.
  • Put the landlords full name here. It must be the same as on the tenancy agreement.

  • Again, this must be the same as on the tenancy agreement. So if there is more than one tenant named on the tenancy agreement you need to put all the names.
  • This needs to be exactly the same as in the tenancy agreement. If you are renting a room in a shared house, make sure you give the room details as well as the address. For example:

    Room 1, 23 The Street, Anytown, Anycounty AA1 2BB
  • DD dash MM dash YYYY
    This needs to be the date of the tenancy agreement this pet agreement is referring to. If you are signing this up before the main tenancy agreement is signed, leave this field blank and write it in later.

  • You can use this area to put in any additional clauses you would like included. They will go in a special area at the end of the standard terms and conditions.

    For example, you may want to increase the rent slightly to take account of the extra wear and tear on the property - a suitable clause could read:

    In consideration for allowing you to rent a room at the property to a lodger, which will cause additional wear and tear at the property, it is agreed that the rent will be increased to £X.

    Maybe get the tenant to specifically initial this clause.

    If you do not add anything here, the form will state N/A by default.
    If so you can make a charge and grant permission on the basis that the rent will be increased. However, this does not apply if the form is being created to use with a new tenancy agreement.
  • If you will be increasing the rent, please put the new rent in the box - for example.

    £1200 per month

    If you are not going to increase the rent, leave the default N/A.
  • Guidance Notes

    Ideally, this agreement should be signed at the same time as the main tenancy agreement. If this is done the tenancy agreement needs to refer to this agreement and state in the additional clauses section that the clause prohibiting subletting clause is amended as set out in the annexed Permission for Lodger Form. You will find a draft clause you can use here (the page will open in a new tab or window).

    If this agreement is signed afterwards (for example if an existing tenant requests leave to rent a room to a lodger) then there is no need to amend the original tenancy agreement as this agreement serves as an amendment document.

    Before this form is signed make sure the date of the tenancy agreement which is being amended is included.

    You will need two copies of this agreement. Both parties should sign at least one copy. Then a copy signed by the tenant should be retained by the landlord (and kept carefully with the tenancy paperwork) and a copy signed by the landlord (or agent on his behalf) should be given to the tenant.

    If the agent signs on behalf of the landlord, you should add the words 'As agent for the landlord' next to the signature.

    Now check that all the information is correct and click to submit.
