Question:

Does the occupant pay rent and have ‘exclusive possession’ of all or part of the property?

‘Exclusive possession’ means that the occupant has the right, or is, in fact, able to, exclude everyone including the landlord, from all or part (e.g. their bedroom) of the property.

For example, this will not be the case if the occupant shares a room with other people, such as in a hostel where people share a dormitory.
