Which possession proceedings?

Question:

Did you serve a possession notice before 1 May 2026?

Although this is the date when stage 1 of the Renters Rights Act 2025 will come into force, the transition provisions of the act provide that valid section 21 notices, and also valid section 8 notices served before commencement (ie before 1 May 2026) can be used:

  • During the notice period of the notice, or
  • Before 31 July 2026

Whichever comes first.

So, no possession claims under the old rules can be brought after 31 July, even if the notice period (under the old rules) had not expired.

It best though to ensure that your papers are sent to the court in good time, bearing in mind that the court office may not issue them immediately upon receipt.
