The final way landlords can obtain possession is under the ‘no fault’ ground which in the Wales legislation is section 173.

This is a mandatory ground, but there are a lot of rules and pre-requsites that you must have complied with before you can use it.  One of these pre-requisites is compliance with the deposit rules which we have already looked at.  We will discuss the other pre-requisites in the final part of this guide.

Note though, that s173 cannot be used during a fixed-term contract, and cannot be used within the first six months of the original contract.  As there is a six-month notice period, this means that s173 cannot be used until the contract holders have been in occupation for over a year.
