No-fault claims for possession
We have now looked at all the various pre-requsites and conditions for bringing a claim for possession using one of the no fault grounds. You must be compliant with all of these to be able to successfully obtain an order for possession.
The no-fault grounds are the contract holders:
- Failure to vacate after service of a landlord notice under s173
- Failure to vacate after service of their own contract holder’s notice to vacate
- Failure to vacate after being served notice under a landlord break clause
Note that a condition of starting proceedings for all of these is that you serve the proper form of notice first. These are all prescribed and can be found on the Welsh gov website and also on Landlord Law (for members) via the Welsh documents and forms page.

At the time of writing, this has not yet been updated to cover the new Welsh possession forms. However, it is similar to the English forms, and our general guidance on accelerated procedures will apply.
