Is the tenancy a protected tenancy regulated by the Rent Act 1977?
This will be if the tenant first moved into the property before 15 January 1989. Protected tenancies were not converted to occupation contracts under the Renting Homes (Wales) Act 2016.
There are fewer and fewer protected tenancies as time goes by, but there are still a good number still in existence. Note that if you have bought a property with a tenant who has been in occupation for a long time, particularly if the property was purchased cheap – the tenancy will probably be protected.
If your tenant claims he has a protected tenancy, has been living at the property a long time, and you are unable to prove that he moved in after 15 January 1989, you will have no alternative but to accept this.
