Answer: Lodger Agreement

Lodger situations where the lodger shares living accommodation with their landlord is an exception to the rule that a residential occupier will have an occupation contract.  This is under Schedule 2 of the Renting Homes (Wales) Act 2016.  So if this applies, then you do not need to comply with the onerous obligations which apply to occupation contracts.

Note though that this is ONLY if living accommodation is shared.  If you rent out accommodation which is within your home but no accommodation is shared other than perhaps a hallway and a staircase, then it will be an occupation contract.
