The Landlord Law Deposit Error Repair Kit

Although the deposit rules have been around since 2007, some landlords still fail to comply and then find themselves in difficulty if they want to evict.

• If they want to use the accelerated procedure (either for section 21 or one of the Welsh no-fault grounds) they will be completely blocked until they sort things out. 
• If they try to evict using the rent arrears ground the tenants will defend by offsetting the financial penalty for non-compliance.

So what can they do?  

Well, the short answer is to refund the deposit money, but it’s not quite as straightforward as that.  There are a number of things to consider, and you need to be able to prove what you have done.
