Deposit error repair kitAlthough the deposit rules have been around since 2007, some landlords still fail to comply and then find themselves in difficulty if they want to evict.

  • If they want to use the accelerated procedure (either for section 21 or one of the Welsh no-fault grounds) they will be completely blocked until they sort things out. 
  • If they try to evict using the rent arrears ground the tenants will defend by offsetting the financial penalty for non-compliance.

So what can they do?  

Well, the short answer is to refund the deposit money, but it’s not quite as straightforward as that.  There are a number of things to consider, and you need to be able to prove what you have done.
