Which possession proceedings?
The first thing to do is to follow the Tenancy Trail and work out what type of tenancy you have.
Note that on 21 December 2022, the law was changed in Wales with the coming into force of the Renting Homes (Wales) Act 2016. This introduced new terminology – which is largely due to the fact that tenancies and residential licenses are now treated the same.
Welsh v. English terminology
- Occupation contract:Â tenancy or license
- Written statement (of occupation contract); Tenancy or license agreement
- Dwelling (sometimes referred to as ‘home’): the property being let
- Contract holder: tenant or licensee
- Occupation date: the date the contract starts
- Term: clause or section in the written statement
- Converted contract – a contract which existed prior to 1 December 2022 as a tenancy or license
- Substitute contract – where a new contract has been signed for a converted contract.
In most cases you will have an occupation contract.
