Which Tenancy Agreement?
Question:
Will the occupier have ‘exclusive occupation*’ of his or her own room**?
You should:
- Click the yes button if you are renting a room just to one person and
- Click the yes button also if the occupiers are signing the agreement as a couple to rent the room together***, as they count as one, but
- Click the no button if you will be letting to individual people (ie not couples) who will be sharing a room, perhaps in a hostel or similar****.
* ‘Exclusive occupation’ means that there is a lock on the door and no-one else has the right to enter the room, other than the landlord in cases of emergency.
** This can also be several rooms, such as a bedroom with ensuite bathroom – so long as the other people (often described as ‘sharers’) in the building who have not signed the same tenancy agreement do not have access to them (usually will often also be ‘common area’ rooms shared by everyone).
*** This can be any sort of couple, same-sex or single-sex, married or not, or even just two or more friends who are not romantically involved. The essential thing is that they sign the same agreement to share the room/s together, and other people in the building do not have access. Generally however for this type of agreement, it will be one person.
**** The essential thing is that their agreement or contract for the accommodation is not shared with the other people in the same room/s.
